Terms of Sales

PREAMBLE

These General Conditions of Sale (hereinafter “GTC”) are concluded exclusively between (1) the company PB Int. Trade, registered with the RCS  Bourg-en-Bresse under the number 889 518 999 whose head office is located at 21 rue due pré aux bouvreuils 01480 Jassans-Riottier in its capacity as publisher of the ubcashmere site. com, service of PB int. Trade, exclusive holder of the license to operate the UB CASHMERe brand on the web and (2) any person making a purchase on the ubcashmere.com site (hereinafter referred to as the “Customer”).  
 
The Customer hereby formally declares that he is an individual, natural person, non-professional or trader, that he is of age or has parental authorization and that he has full and complete legal capacity to contract and perform order online at ubcashmere.com.
 
The Client and UB CASHMERE jointly agree that their relations are governed exclusively by these General Terms and Conditions of Sale.
In this respect, the Customer acknowledges that any order validated by "double click" implies irrevocable adherence to these General Terms and Conditions of Sale. This validation of the Customer associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages constitutes the manifestation of the unequivocal will of the Parties thus deemed to be signatories of the act of distance selling.

UB CASHMERE reserves the right to adapt or modify these General Conditions of Sale at any time. Each order will be deemed to have been subscribed according to the terms of the GTC in force on the day of its placing on the kujten.com site, the date of posting of the GTC being the date of entry into force.
 
For any question relating to an online purchase, the Customer can contact UB CASHMERE Customer Service.

ARTICLE 1. VALIDATION OF THE ORDER ON THE UB CASHMERE SITE

To place an order on the ubcashmere.com website, the Customer will be guided through the following steps:
-   Selection of products on the site in the "Basket",
-   Choice, when offered, of the delivery method for the products displayed in the "basket",
-  Presentation of the summary of the order, modifiable, and its total price,
-   Choice of payment method,
-   Sending an order validation email to the Customer confirming his registration after acceptance of his payment.

The order validation email sent to the Customer confirms the acceptance by UB CASHMERE of the Customer's order, and confirms the formation of the sales contract between the Parties.

ARTICLE 2. VALIDITY OF OFFERS - AVAILABILITY OF PRODUCTS

The products displayed on the kujten.com site at a given moment are in principle deemed to be available in stock at that same moment, except for a limited time offer within the framework of a particular operation expressly mentioned as such on the product page.

This a priori availability is checked after the order has been accepted for payment and is confirmed by sending the dispatch email by UB CASHMERE.
In the event of unavailability of one or more products, UB CASHMERe undertakes either to offer the Customer a new delivery date for the product(s) ordered or to reimburse them by recrediting the means of payment used during the purchase, and this within 14 calendar days of payment of the order. If a technical event prevents the recrediting of the means of payment used, UB CASHMERE will offer the Client to issue a bank check to his order and send it by post to the billing address as provided.   

The product and price offers are deemed to be those that are displayed during checkout represented by the "CART" page of the ubcashmere.com website. Thus, only the price indicated on this page, corresponding to that invoiced to the Customer when of his order, is authentic and commits UB CASHMERE from a contractual point of view. Therefore, any typographical error on any other page likely to occur on graphic and/or promotional elements within the site, cannot engage the responsibility of UB CASHMERE.

ARTICLE 3: PRICE

The prices displayed on the ubcashmere.com site are expressed in euros (€) and are understood to be public prices, all charges included, as they may be applicable in mainland France on the date of consultation of the said offers. The VAT applied is that in force on the date the order is placed. The specific taxes, apart from VAT, applicable according to the regulations (such as the furniture ecotax or the ecotax participation), are only indicated on the basket page, the only page to be taken as indicated. in the last paragraph of article 2 above.
 
All product prices are displayed on the kujten.com site excluding postage or any other ancillary service. They only include the price of the product itself, as described and its packaging.
 
UB CASMERE reserves the right to modify its prices at any time but undertakes to apply the prices displayed at the time of placing the order, subject to availability on that date.
 
The products remain the property of UB CASHMERE until full collection of the price by the latter.

ARTICLE 4: PAYMENT

4.1 PAYMENT TERMS

Regardless of the method of payment chosen from among those accepted on our site, orders will only be deemed registered after validation or receipt of payment.
Thus, as long as the payment is not validated by the intermediary chosen by the consumer, the order cannot be prepared by the UB CASHMERE services.

4.1.1 Cash payment by credit card

Payment can be made by the following bank cards: Carte Bleue, VISA, MASTERCARD
The Customer is able to consult the General Conditions of Sale and Use of each of these bank cards on the sites of our partners.
The choice of one of these payment cards implies tacit acceptance of the general conditions of sale and use of said partners.
We invite our customers to refer to it, UB CASHMERE cannot be held responsible for the conditions thus imposed by these independent partners.
 
Online payment by credit card is completely secure and allows you to enter the card number, expiry date and security code in the spaces provided for this purpose. Credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network. Payment is made directly to the bank. UB CASHMERE has no access to these contact details and cannot store them on its servers. This is why they are requested again with each new transaction on our site.

4.1.2 Cash payment by Paypal

Payments by Paypal are accepted on the kujten.com site and are then made through the partner in question and according to its own general conditions of sale and use of its services. 
The choice of this payment implies tacit acceptance of the general conditions of sale and use of the Partner.
We invite our customers to refer to it, UB CASHMERE cannot be held responsible for the conditions thus imposed by these independent partners.

4.2 FIGHT AGAINST FRAUD

UB CASHMERE reserves the right to check the validity of the payment, before shipping the order, by any means it deems necessary (including identity documents, proof of address, etc.).

4.3 PAYMENT INCIDENT
 
UB CASHMERE reserves the right to refuse to make a delivery or to honor an order from a Customer who has not fully or partially paid a previous order or with whom a payment dispute is in progress. In the event of fraud, UB CASHMERE reserves the right to remove any member without notice or compensation.

ARTICLE 5: DELIVERY

5.1 ORDER PREPARATION TIMES
 
UB CASHMERE reserves the right to subcontract all or part of the preparation and dispatch of the order to a third party mandated to perform this service.
All products sold by UB CASHMERE being deemed to be available in stock, orders are prepared between 1 and 3 working days from the first working day following the registration of the order within the meaning of these GCS. Thus, orders placed on a Saturday, Sunday or public holiday will be processed on the next working day.

All of the deadlines mentioned on the ubcashmere.com site are understood as clear deadlines.
The ordered product is delivered to the address appearing on the order form and recorded as the “delivery” address.
In the event of an input error, in particular an erroneous or incomplete delivery address, UB CASHMERE cannot be held responsible for the consequences in terms of delay or impossibility of delivery. All costs related to the reshipment of products following an input error by the Customer will be the sole responsibility of the latter.

5.2 ORDER DELIVERY TIMES

UB CASHMERE reserves the right to choose the most appropriate mode of transport depending on the nature of the product, its weight and its volume, which the Customer declares to have read and accepted.

Delivery times may not exceed 30 working days after the date of validation of payment by the Customer (date of registration of the order).

Delivery times cannot be guaranteed in the event of force majeure, as defined by law and case law. The delivery times do not take into account any procedures for checking the Customer's payment which would delay the dispatch of his order (cf. provisions of article 4.2).
The announced deadlines run from the registration of the order. The expected delivery date is indicated when ordering and on each of our product sheets. This time is an average time corresponding to the service used for delivery in mainland France. In case of absence, the Customer will be responsible for recovering the product from the departments concerned.

5.3 DELIVERY TRACKING

The Customer can at any time follow his order using the order number which is communicated to him in the email formally recording his order, and the postal tracking number communicated.

  
It is recalled that all communication between the Client and the ubcashmere.com site being essentially carried out through email exchanges, it is essential that the Client sends UB CASHMERE a valid and regularly updated email address. . Failing this, UB CASHMER cannot be held responsible for the consequences resulting from the communication of an incorrect or non-updated email address.

5.4 DELIVERY AREAS

UB CASHMER delivers worldwide.

5.5 SPECIFIC DELIVERY TERMS

The delivery methods for UB CASHMERE products are established by UB CASHMERE and depend on their admission in postal volume.

When a product is admitted in postal volume, the Customer will benefit from delivery to his home by Colissimo.
 
At the end of the validation of these transport methods and before the payment of the order, the ubcashmere.com site will display a summary of the order by mode of transport, to which the products in question are eligible and according to the option chosen by the Customer when it was offered to him. The cost of the modes of transport affected or chosen will then be displayed before the payment of the order.

When the order has been duly prepared and will be ready for dispatch, the Customer will receive an email relating to the dispatch of each part of his order by means of transport thus agreed.
 
⇒   Delivery by DHL (outside France):

Delivery by DHL meets its own General Conditions of Use. Shipments cannot be delivered to PO boxes or postal codes. Shipments are delivered to the address provided by the Recipient when ordering but are not necessarily delivered by hand to the designated recipient. Shipments to addresses with a central receiving area will be delivered to this area.

DHL may notify the recipient of an upcoming or missed delivery. The recipient may be offered an alternative delivery option such as delivery on an alternate date, signatureless delivery, re-routing of the shipment, or delivery to a DHL Relay Point.

Failing this, the order will be forwarded to UB CASHMERE who will remind the customer by email to re-send his order to him at his expense. Without a return from the customer within 7 days of sending this reminder email, UB CASHMERE will consider that the customer has exercised his right of return and will proceed with the refund under the conditions provided for the exercise of the right of withdrawal (see article 6 -1 of these T&Cs)
 
⇒   Delivery by Colissimo:

Delivery by Colissimo is a service offered by La Poste française and meets its own General Conditions of Use. In the event of absence and impossibility of depositing the package with a caretaker, the Customer will receive a notice of passage. He will then have a period of 14 calendar days to pick up his parcel from the post office indicated on the said notice. Failing this, the order will be forwarded to UB CASHMERE who will remind the Customer by email to re-send his order to him at his expense. Without a return from the Customer within 7 days of sending this reminder email, UB CASHMERE will consider that the Customer has exercised his right of return and will proceed with the refund under the conditions provided for the exercise of the right of withdrawal (see article 6 -1 of these T&Cs.

5.6 DELIVERY RATES

For any order above 300 euros in metropolitan France, delivery will be free.
 
For any Colissimo delivery in France and Monaco the cost is 15 euros.
 
For any DHL delivery outside Metropolitan France the cost of delivery is 25 euros
 
The amount of the costs is automatically calculated as soon as a product is added to the basket on the basis of a delivery in mainland France. The Customer can freely consult the billing and the carrier associated with his products.

The final calculation of the shipping costs for other destinations is made once the postal code has been entered on the delivery address and before the validation of his order by the Customer.

The specific offers in free shipping are only valid within the framework of a shipment to mainland France, unless expressly stipulated otherwise.

ARTICLE 6: RIGHT OF WITHDRAWAL

6.1. CONDITIONS FOR EXERCISE OF THE RIGHT OF WITHDRAWAL

⇒  Delay:

In accordance with the provisions of Article L. 121-21 of the Consumer Code, the Customer has a period of 14 calendar days to exercise his right of withdrawal, without needing to justify any reason. The period runs the day after the day of receipt of the order.
In the case of an order relating to several goods delivered separately or in the case of an order for a good made up of lots or multiple parts, the delivery of which is staggered over a defined period, the period runs from receipt of the last good or lot or of the last piece.
For contracts providing for the regular delivery of goods during a defined period, the period runs from the receipt of the first good.
 
⇒  Exercise of the right of withdrawal:

To exercise his right of withdrawal, the Customer must inform  CASHMERE decision by sending him, before the expiry of the aforementioned 14-day period, the standard withdrawal form provided for this purpose, which will have been sent to him with the email confirming his order (and reproduced in the appendix to these T&Cs), or any other unambiguous statement expressing his desire to withdraw.


⇒   Loss of right of withdrawal:

Pursuant to Article L 121-21-8 of the Consumer Code, it is recalled that the right of withdrawal cannot be used for contracts:
1° For the supply of services fully performed before the end of the withdrawal period and the performance of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal;

2° Supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period;

3° Supply of goods made to the consumer's specifications or clearly personalized;

4° Supply of goods likely to deteriorate or expire rapidly;

5° For the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

6° Supply of goods which, after having been delivered and by their nature, are inseparably mixed with other items;

7° Supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations in the market beyond the control of the professional;

8° Maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him, within the limit of spare parts and work strictly necessary to respond to the emergency;

9° Supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;

10° Supply of a newspaper, periodical or magazine, except for subscription contracts to these publications;

11° Concluded during a public auction;

12° Provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a given date or for a specific period;

13° Supply of digital content not provided on a material medium, the execution of which has begun after the consumer's express prior agreement and express waiver of his right of withdrawal.

⇒   Product Condition Condition:

For the exercise of this right of withdrawal, the returned product must be returned in a condition allowing its immediate resale. The product must therefore be returned in its new condition, provided with all the instructions and various accessories with which it was delivered and in its original packaging. UB CASHMERE reserves the right to refuse reimbursement of the product if all of these conditions were not met.

⇒   Refund terms:

In the event of exercise of the right of withdrawal within the aforementioned period, and in accordance with the provisions of Article L121-21-4 of the Consumer Code, B CASHMERE will reimburse the Customer for the price of the returned product(s) as well as the shipping costs. shipment of the product(s) in question within 14 calendar days from the date on which it was informed of the Customer's decision to withdraw
UB CASHMERE nevertheless reserves the right to defer reimbursement until recovery of the goods or until the Customer has provided proof of the shipment of these goods, the date chosen being that of the first of these two events.
Reimbursement will always be made on the basis of the sums actually paid by the Customer, as indicated on his invoice. However, UB CASHMERE reserves the right to refuse to reimburse the additional delivery costs generated by a more expensive delivery method expressly chosen by the Customer when UB CASHMERE had offered him a standard delivery method.
The transport costs to be reimbursed will be determined as if the Customer had never purchased the returned product(s).
Finally, in principle and unless otherwise expressly requested by the Client, UB CASHMERE will reimburse the latter by re-crediting the means of payment used during payment. In case of material impossibility to use this process, UB CASHMERE will propose to the Customer to issue a bank check to his order for the amount due and to send it to him by post.

⇒   Charge for return shipping costs:

Return costs are expressly borne by the Customer, who acknowledges and accepts it by adhering to these General Terms and Conditions of Sale.

ARTICLE 7: COMPLAINT ON THE ORDER

If during the unpacking of his products and within 15 calendar days from receipt of the products, the Customer discovers that a product does not comply with his order or the product sheet (example: error on the product, the model, color, other) UB CASHMER then undertakes to replace it or to reimburse the Customer for all of its costs as soon as the defect is noted and confirmed.
 
To do this, the Customer must contact UB CASHMERE Customer Service to make their complaint and follow the given procedure.
After receipt of the duly returned product and finding of non-compliance or damage reported by the Customer, UB CASHMERE may, at its sole discretion,
-  Either send a new product to the Customer, at no additional cost,
-  Either refund the amounts paid when purchasing this product.
Any other potential defect during the "life" of the product will be appreciated within the framework of the recourse to the after-sales service.

ARTICLE 8: After-sales service

Apart from the commercial or legal guarantee, the Customer always has the option of contacting UB CASHMERE Customer Service to answer questions relating to the use of a product, its maintenance procedures or the order of a part that has become defective.

ARTICLE 9: INTELLECTUAL PROPERTY

All elements of the kujten.com site, whether visual or audio, including the brand, logo, text, photos, videos and domain name, are protected by copyright, trademarks or patents. The Publisher of the ubcashmere.com site holds an exclusive licensing and operating agreement granted by their owner. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code.

Any total or partial reproduction of the kujten.com site or of any of its audio, visual or text content is strictly prohibited without express prior written consent.  

ARTICLE 10: RESPONSIBILITY

For all stages of access to the site, the ordering process, delivery, Customer service or subsequent services, UB CASHMERE only supports an obligation of means. Consequently, UB CASHMERE cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses, or any event qualified as force majeure. , in accordance with case law.
In addition, UB CASHMERE cannot be held liable in the event that the order does not succeed or if it is prevented from respecting any of its obligations for a case of force majeure within the meaning of case law, and in particular in the event of bad weather preventing the delivery of the order.

ARTICLE 11: ENTIRETY

In the event that one of the clauses of this contract is declared void by a change in legislation, regulation or by a court decision, this can in no way affect the validity and compliance with all the other provisions of these Terms of Sales.

ARTICLE 12: DURATION

These T&Cs apply for the entire duration of the online services and products offered by UB CASHMERE.

ARTICLE 13: PROOF

The computerized registers, kept in the computer systems of UB CASHMERE and its partners under reasonable security conditions, will be considered as proof of the communications, orders and payments made between the Parties.

ARTICLE 14: STORAGE AND ARCHIVING OF TRANSACTIONS

The archiving of purchase orders and invoices is carried out on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.

ARTICLE 15: DISPUTES

These conditions are subject to French law.
In the event of a dispute, UB CASHMERE and the Client will attempt to resolve it amicably, within the framework either of a conventional mediation procedure or of any other alternative method of settling disputes. In case of failure of the transaction, only the French courts will be competent.
